Media reports over the weekend point to the critical month ahead in the U.S. Supreme Court where several potentially transformative cases impacting religious liberty are pending a decision. One of those critical cases, Masterpiece Cakeshop v Colorado Civil Rights Commission, deals directly with marriage and could provide the protection from persecution we've been fighting to achieve for many years.

NOM has been an active defender of Jack Phillips, a Christian baker who respectfully declined to devote his artistic talents to designing and producing a custom cake for a same-sex 'wedding.' His objection to this was rooted in his Christian faith. The bible teaches us that marriage, created at the beginning of time by God, is the union of one man and one woman. Jack Phillips has devoted his business to honoring God, and he could not be involved in something like a gay 'wedding' that dishonors biblical teaching.

Simply for standing true to his Christian beliefs, Jack was targeted and punished, ordered by the state of Colorado to participate in gay 'weddings' despite what the bible teaches about marriage. He and his staff were ordered to undergo "sensitivity training" and file compliance reports with the state of Colorado. Failure to comply risked fines and other punishments.

Let's be clear: the LGBT extremists who target people like Jack are not out to get someone to bake a gay 'wedding cake.' After all, there are countless bakers who would have been perfectly fine baking a cake for the homosexual couple. Instead, they target people of faith to send a message that acceptance of same-sex 'marriage' is mandatory and resistance, even when based on the bible, is futile.

Back in the day, LGBT activists promised that the imposition of same-sex 'marriage' would affect nobody but loving gay couples. When NOM warned that this was not true, that once gay 'marriage' was imposed, opponents would be treated like racists under the law, we were accused of hate mongering, scare tactics, homophobia, and worse.

  • Until then, a ruling by the US Supreme Court that it is NOT discrimination for someone to decline to participate in a same-sex 'wedding' that violates their religious beliefs is essential. We could get such a ruling within weeks in a case that NOM is playing a crucial role in supporting (the Masterpiece Cakeshop case);
  • State and federal legislation protecting the rights of people to live out their beliefs about marriage in their daily lives and at work must be enacted. We are working in Congress and in the states to pass such legislation; and
  • Executive orders by President Trump and key federal and state officials can and must be issued that would provide a measure of protection for marriage supporters. We are actively pursuing these orders.

The Masterpiece Cakeshop case is just one example of many where NOM has been active in the Courts. For example, we were a leading defender of a local school district that decided to maintain the security and privacy of its school restrooms, locker rooms and showers despite demands by a transgender student and liberal legal groups. Earlier this month, we were able to rally thousands of NOM members to contact Senator Rand Paul to urge him to vote to confirm pro-marriage Secretary of State nominee Mike Pompeo. Pompeo had been viciously attacked by liberal Senator Cory Bookerbecause of his support for traditional marriage, and Sen. Paul had voiced his opposition to Pompeo on other grounds. But after NOM swung into action, Sen. Paul announced a change of heart and Pompeo was confirmed. This shows what we can do when we work together!

Marriage has NOT been repealed

The other day, a member of our team was approached by an American university student studying abroad. For a paper assigned by her university, she wanted to talk about the passage of Proposition 8 in California, and "the repeal of Prop. 8."

Of course, we immediately wrote back to inform her that Proposition 8 has NOT been repealed! Prop 8 remains part of the California constitution, as do the laws in dozens of other states that define marriage as only the union of one man and one woman.

Please help us in our fight to restore marriage to our country's laws.

The only thing that has happened to Prop 8 and all the other pro-marriage laws in states around the country is that they are not being enforced because of the illegitimate, anti-constitutional ruling by the US Supreme Court in the Obergefellcase imposing gay 'marriage' on the nation.

I suppose that it's not surprising that leftist universities, egged on by LGBT activists, are indoctrinating students to a false narrative, that traditional marriage has been repealed. The left never bothers itself with facts when they get in the way of their agenda.

While it may be inconvenient for the left, the fact is that Proposition 8 in California and the laws in dozens of other states remain on the books and will come back to life when the Obergefell case is eventually overturned, which it clearly should be and we believe will be, perhaps sooner than people imagine.

We are just one vote shy of having a pro-marriage majority on the US Supreme Court. If Anthony Kennedy decides to retire this year as many expect, we will have a realistic chance to promote a pro-marriage nominee from President Trump in the mold of Antonin Scalia and Neil Gorsuch.

It's hard to believe that the Proposition 8 campaign unfolded ten years ago. NOM played a pivotal role in the success of Prop. 8, helping to organize the signature gathering drive that put it on the ballot. I moved my family to California so I could work fulltime on the campaign. And our national Political Director, Frank Schubert, was the campaign manager for the successful effort. It was a great victory, which makes it all the more important that we reverse the injustice done to the people of California, and all the other states that voted for marriage, to have had that victory illegitimately stolen by the US
Supreme Court.

Help Stop Another Attack on Believers in the Senate!

It's happened again. A pro-marriage conservative has been blackballed by a liberal Democrat, told he can't serve in government because he believes that marriage is the union of one man and one woman!

Remember when the LGBT crowd promised…swore!...that there would never, ever be any consequences if people just allowed loving gay couples to marry? Well, we've long known that was a lie. The idea of 'gay marriage' was quickly weaponized and is today being used against people of faith on an unprecedented scale.

Will you help us put an end to this?

The latest case involves Gordon Giampietro, a distinguished former federal prosecutor and devout Catholic who has been nominated by President Trump to the federal bench in the eastern district of Wisconsin. He's pro-marriage and pro-life, and has been highly critical (as have dozens of prominent legal scholars) of the US Supreme Court's Obergefell decision imposing same-sex 'marriage' on the nation.

But in the view of uber-leftist Senator Tammy Baldwin of Wisconsin, being pro marriage disqualifies Giampietro for service on the bench. She's decided to blackball Giampietro, denying him the Senatorial courtesy of a "blue slip" (a formal approval required by Senate custom by the nominee's state's Senators) and by this means Baldwin hopes to derail Giampietro's nomination.

We only just recently dealt with a similar attack on President Trump's nominee for Secretary of State, Mike Pompeo, by liberal Senator Cory Booker. But we responded quickly and effectively to that attack, and that's part of the reason Pompeo is now Secretary of State! Well, we made a difference before - we can do it again!

Let me make two critical points:

  • First, Tammy Baldwin is engaging is rank religious discrimination, drawing a line in the sand that no faithful, orthodox Catholic could ever cross. The teaching of the Catholic Church is crystal clear – marriage is only the union of one man and one woman. Under Baldwin's doctrine, being a faithful Catholic thus disqualifies anyone from service in the federal judiciary!
  • The second point is this – why in the world do we allow Senators like Tammy Baldwin the ability to control the federal judiciary by invoking some arcane privilege of "withholding a blue slip"? This is insane!If Baldwin wants to vote against a judicial nominee because of his views about marriage, that's her prerogative (as wrong as she may be). But she has no right to single-handedly derail the nomination and prevent it from advancing to a confirmation vote simply by withholding a mere customary courtesy nod that was never intended to be such a tool of discrimination!

If you agree with me that it's wrong to let liberal Senators like Tammy Baldwin hold the judiciary hostage and then deny the American people the opportunity to be served by strong, conservative judges who believe in the Constitution, it's time to take action. Please sign our petition to Senate Leader Mitch McConnell to stop Baldwin's bigoted attack on believers!

Senate Leader Mitch McConnell has done some good things when it comes to judicial confirmations. For instance, he was instrumental in putting an end to the ability of a minority of Senators to block a vote on a Supreme Court nomination through filibuster. By using the so-called "nuclear option," the Senate confirmed Neil Gorsuch to the US Supreme Court.

Now it's time for Sen. McConnell to take the necessary steps to move forward with President Trump's nominations of conservative, constitutional originalists like Gordon Giampietro. Sen. McConnell must put a stop to Baldwin's unconstitutional religious test and confirm these judicial nominations immediately! Please sign our petition today.

The importance of the work that we do here at the National Organization for Marriage was brought home to me recently when I read an opinion editorial piece in the Washington Post last week. The piece makes the stakes of our fight very clear, and the urgency with which we need your help to continue doing that work.

It was written by Jack Phillips, the plaintiff in the Masterpiece Cakeshop Supreme Court case Brian mentions below. The piece was entitled, "I’m the Masterpiece Cakeshop baker. Will the Supreme Court uphold my freedom?"

In it, Jack wonders about the outcome of his critical case, which is expected to be delivered soon. Musing on what should happen if the Supreme Court rules against him, Jack reflects grimly on the future:

I shudder to think what I’d say if my granddaughter one day tells me that she wants to design wedding cakes like I did. I guess I’ll tell her that she must choose between the faith we taught her and the wedding-cake artistry I showed her.

But Jack then turns to the hope that the Supreme Court will rule in his favor, as we urged the Court to do in our amicus brief supporting Jack:

But if the court upholds my freedom to serve all people while declining to design cakes that celebrate certain events, that would welcome me back into the community from which I’ve been estranged. Those who are opposing me in court have compared me to racists and argued that I’m deserving of their fate — social marginalization. But a ruling for me would reject all that and declare to the world that my faith is not a scarlet letter. [...] We all want to belong. I’m no different. The Supreme Court’s decision in my case will say a lot about the First Amendment. But I sure hope the court makes it clear that I belong, too.

Friends, our hope is the same as Jack's. But even if the Court does rule in his favor, the fight to ensure that our faith and belief in marriage belongs in the public square will continue. As Brian's said in yesterday's email, there will be more legal battles, elections, and possible confirmation hearings for a new Supreme Court Justice, and in every one of these contests, marriage and religious liberty will need a strong and clear voice of defense. We hope to be that voice, for you and countless Americans like you. But we can't do it without your support.
