Today's the Day

One Retirement Away


Yesterday there was some media buzz about a comment that Supreme Court Justice Ruth Bader Ginsburg made, saying she had no plans to retire from the Supreme Court. This sent liberals off to celebrate, being reassured that one of the most liberal members of the Court planned to stay on. Of course, the Ginsburg story is a bit of fake news, because no Democrat would voluntarily retire when a Republican president is in office.

But the statement from Ginsburg does serve to illustrate a very important point for all of us at NOM: we could be only one retirement away from having a majority on the Supreme Court that could vote to restore marriage to our nation's laws.

Please help us have the resources we need to influence the future makeup of the Supreme Court, and to move our aggressive agenda forward.

Many people in the elite are fond of saying that "marriage is lost," but marriage is not lost. First of all marriage is an immutable, universal relationship - the union of one man and one woman - and no decision of any court or politician can change marriage. Thus, marriage will never be "lost" because it is a permanent, universal truth. But more to the point of the political discussion, marriage is not "lost" as a public policy issue because the rationale used by the Supreme Court in redefining marriage in 2015 was so specious, so utterly lacking in judicial precedent and legal foundation, that the retirement of a single justice who voted to redefine marriage could totally upend the situation and bring marriage back before the Supreme Court with a realistic opportunity to restore marriage.

And we could very well have just that situation occur later this year if Justice Anthony Kennedy retires from the Supreme Court, as many have speculated he will do.

And of course, it's no secret that most of the liberal justices are quite elderly and the cold reality of life is that nobody lives forever.

This is one of the reasons that a top priority of NOM's 2018 Strategic Plan is to work to keep marriage before the American public so that it can be restored to our laws at the earliest possible moment.

We don't know when our moment will arrive, but we do know this: we need to be ready to capitalize as soon as it does arrive. And that means that we need to upgrade our financial base, starting now.

Arrested for praying in America


Not too long ago, a teenager in Tennessee who wanted to deliver a prayer at graduation was threatened by the school principal with being physically removed from the ceremony and arrested. This shocking development is but one example of what is going on in America today when it comes to the trampling of our constitutional rights to religious liberty. In fact, a report by our friends at the Family Research Council found that there was a 76% increase in incidents of government intolerance of religion under President Obama's administration.

NOM is fighting to protect our religious liberty rights, including the right to believe in marriage as God designed it, the union of one man and one woman. But to be effective, we need your support and financial assistance.

In today's culture, LGBT activists and their allies in entertainment, media and corporate boardrooms seek to portray marriage supporters as bigoted, hateful people who want to discriminate against the LGBT community. While they acknowledge that the constitution protects religious liberty, they wish to cabin the exercise of religion to the four walls of the church, transforming religious liberty into a "right to worship." This view asserts that Americans are free to hold whatever beliefs they may wish, but they are not free to act on those beliefs if they are counter to the prevailing views of the elite.

We at NOM will never stand for this diminution of our constitutional rights.

America was founded on the premise of religious freedom. Those who risked their lives to come to this land did so to pursue this bulwark of freedom. Our nation's founders realized an eternal and extraordinarily important truth, that men and women are endowed with inalienable rights, rights that are not a gift from government or an entitlement from the state. They are an endowment from God, the creator of the universe and the source of what makes America exceptional among all the nations of the earth.

And our founders also realized something else: religious freedom is so central to our existence that it must be fought for and defended against those who would suppress it and ultimately seek to extinguish it.

Fighting for and defending our religious liberty is a critical element of our 2018 Strategic Plan. Recently, NOM launched a major new initiative, the First Freedom Initiative, to create a cohesive, compelling, consistent case for the right to act on our deeply held beliefs about marriage and traditional biblical morality. Continue the Fight for Religious Liberty

We are working with the Trump Administration to protect our rights, and have enjoyed several high-profile victories. Recently, Attorney General Jeff Sessions issued a government-wide directive that the religious liberty rights of all Americans must be protected to the maximum extent possible. We're urging President Trump to add teeth to that directive by issuing a formal Executive Order, and we are working with Congress to pass the First Amendment Defense Act to enshrine legal protections into statute. We're also working at the state level to enact local protections, are active in the courts and are hard at work to shape attitudes about these issues in the court of public opinion.

Protecting the Truth of Gender


Dear Marriage Supporter — After LGBT extremists were successful in redefining marriage in the law, stripping it of its essential character as a gendered institution, they then pivoted into a headlong rush to redefine gender itself. A key element of our 2018 Strategic Plan is to fight this attempt to deconstruct gender, because it is unalterably connected to the fight for marriage as a gendered institution bringing the two halves of humanity together. We are one of few national groups pushing back against this "gender identity" phenomenon through public education, grassroots organizing, legal action and administrative, regulatory and legislative activities.

Please help NOM continue the fight for the truth of gender, working to protect innocent children and families from being damaged by this dangerous "gender identity" ideology.

The new orthodoxy being spread by the LGBT community and their allies is to portray laws and cultural mores that segregate areas such as restrooms, changing rooms, showers and locker rooms based on sex to be discriminatory, bigoted and harmful to those who claim to be "transgendered."

Make no mistake about it – there is harm to the "transgendered" (and many others) inherent with this agenda, but it comes from those pushing it, not from groups like NOM who are resisting. The harm is visited upon many constituencies, but first and foremost are those young people who are confused about their gender. Most parents of gender-confused children are truly concerned about the child's well-being and don't know what to do. They are not told by medical, psychological or educational professionals that almost all children who experience gender dysphoria will grow out of it by the time they go through puberty. They just need love and support, not medical intervention. Instead, parents are influenced by the headlong cultural push to channel these kids into "gender identity" programs and clinics. Once that happens, the odds are very high that the child's life will be radically and permanently damaged.

The causes of gender dysphoria are not biological; nobody is born trapped in the wrong body. The causes of this condition are often complex and difficult to ascertain. There is little doubt that cultural developments play a major factor. We have seen the incidents of claimed transgenderism skyrocket in the past couple of years as the media has flooded the culture with portrayals of transgendered people.

Continue the Fight for the Truth of Gender

Here is an example: A prominent pediatrician recently shared the story of her patient, a young boy, who insisted that he was really a girl. He demanded of his parents that they treat him like a girl. The pediatrician decided to have the child undergo an independent psychiatric evaluation to understand what was happening to cause this situation. Over time what they learned was that when the boy's parents had a second child – a girl with special needs – the boy felt the loss of their affection and witnessed the parents shower the girl with attention. The boy concluded that his parents did not love boys, they loved girls – and he decided he wanted to be a girl.

This tragic situation is playing out with increasing frequency today. The incessant push by the media, Hollywood and the entertainment industry of all-things transgendered has resulted in a skyrocketing of claimed incidences of transgenderism. Britain's National Health Service reports a quadrupling of children under age 10 who have been referred for treatment related to gender dysphoria.

Please help us present the truth of gender to the American people and spare countless children from this dangerous gender-identity ideology.

Unfortunately, many medical professionals today would not seek a truly independent evaluation of a child presenting as transgendered; they would refer the child to a gender-identity clinic that exists to help facilitate the "transition" of the child from their true gender to the one they have chosen. The child will begin to "present" as the opposite sex, choose a name representing the opposite sex, and eventually start taking powerful hormones and drugs to suspend normal physical development.

This situation is tragic for all involved, but it is more than that because there are more people impacted than those who are personally experiencing this problem. Society as a whole is impacted.

Every child in public school must deal with the situation of a student who one day is their true gender, but the next is said to be the opposite gender, with a new name, different clothing, and unfettered access to intimate school facilities of the opposite sex. A child who uses common sense and observes that the student has not really changed genders will soon find himself or herself in trouble with school officials, subjected to discipline and punished, perhaps expulsion, for expressing the obvious truth of his or her observation. The young girl who is uncomfortable showering next to a student with male genitalia will be told that her discomfort is her problem, and she will not be allowed to make the transgender student feel like there is something different about him. Her concerns for privacy and modesty are pushed aside as irrelevant, or worse, signs of bigotry and hatred.

And so it goes.

The LGBT extremists have been joined by powerful groups and organizations that seek to align themselves with the LGBT community including representatives of sports, medicine, the law, and major corporations. For the most part, these groups do not attempt to present a compelling argument that gender is fluid and based on emotions and identity, but rather seek to impose this cultural perspective through intimidation and force. They had a powerful ally in President Barack Obama, who used his power to direct the federal government to institute a widespread policy of "gender identity" affirmation, including in the public schools and the military. Other Democratic leaders, from Governors down to local officials, have adopted a similar posture. Thus, the push to redefine gender has gained tremendous momentum in a short period of time.

NOM is one of few national groups pushing back against this phenomenon. We are active in fighting for the truth of gender through a variety of activities, including:

a.

Public education. NOM co-sponsored the #FreeSpeech bus tour to highlight the truth of gender, that it is based on biology and not feelings, emotions or politics, which generated a huge amount of media coverage. The tour graphically illustrated the intolerance of LGBT activists who often resorted to violence to prevent a civil discussion of the issues. We also aggressively have promoted credible medical research that undercuts the push for transgenderism, including the ground-breaking work of scientists last year that established that transgender treatment protocols such as puberty blockers and hormone treatments are not safe, accepted and fully-reversible, as activists claim, but in reality are "drastic and experimental" and often result in serious medical harm and irreversible consequences to children, including infertility. We continue to publicize important medical and scientific research into transgenderism, as well as undertake public events to bring attention to these issues.

b.

Administrative Action. NOM has enjoyed tremendous success with the Trump administration in reversing the President Obama's complete embrace of attempts to redefine gender. We successfully urged President Trump to rescind Obama-era guidelines to the public schools to treat gender as meaning "gender identity." As a result of rescinding the redefinition of gender in the schools, countless school children will be spared the imposition of being exposed to the biological opposite sex in the most intimate areas of campus. We also successfully urged President Trump to end Obama's use of the military to advance the transgender agenda, and he's restored policies that prohibit the transgender from serving in the armed forces. We will continue to look for administrative and regulatory opportunities to rollback advances in the transgender movement.

c.

Legal actions. NOM has also successfully fought for the truth of gender in the courts. We filed an amicus brief successfully urging the Supreme Court to uphold the right of a public school district to protect the privacy and security of students by limiting access to intimate sex-segregated facilities to members of the appropriate biological sex. The Supreme Court did so. We are also urging the Supreme Court to accept another important case that would establish it is not "sex discrimination" or "sex stereotyping" for a school district to require that boys and girls use separate bathroom facilities that correspond to their biological sex. The case is currently pending review. NOM will continue to be a forceful advocate for the truth of gender in the courts.

As I have said, NOM is one of the few national organizations to make the push for truth in gender a main focus. It's important work, but it can be very difficult. Quite literally, members of our team have been physically threatened simply for trying to discuss the issues, and we are regularly disparaged and harangued on social media and in the mainstream press. We will stand strong for the truth, but we need to know that you are standing with us.

Fighting to Protect Supporters of Marriage


Dear Marriage Supporter — One of the top objectives we've laid out in our 2018 Strategic Plan is to pursue a comprehensive series of actions to protect the right of people who believe in traditional marriage to live out their beliefs in their daily lives and at work. Increasingly, marriage supporters have been targeted by government officials and others for punishment simply because of their belief in what the Bible teaches and all of human history has shown, that marriage is the union of one man and one woman.

Stand Up for Marriage Today!

It is imperative that supporters of marriage be able to act on their beliefs about true marriage and not be coerced or threatened with punishment for maintaining those beliefs. Polling shows that an overwhelming percentage of Americans believe that nobody should ever be forced to be involved in a same-sex ceremony against their wishes, yet countless people have been targeted for declining to be personally involved in the lie of same-sex 'marriage'.

We have an integrated plan to make sure that the rights of supporters like you and I are protected. Our plan includes:

a. Participating in Critical Legal Cases. NOM has filed important amicus briefs in critical cases pending in the Courts and has urged the Supreme Court to act to protect people of faith from being forced into participating in same-sex ceremonies against their wishes. A critical case in that regard is currently pending before the Supreme Court, Masterpiece Cakeshop v Colorado. NOM is participating in this case as amicus on behalf of baker and cake artisan Jack Phillips. This is one of the most important religious liberty cases to ever come before the Supreme Court.

b. Administrative Action. We are working hard at the federal level to secure administrative action to protect people of faith, and have already won an important victory. After a great deal of urging by NOM's supporters, last October, Attorney General Jeff Sessions issued a government-wide directive ordering every department and agency within the federal government to protect the religious liberty rights of people of faith. This is a big win for NOM, but more can and should be done. This year we will launch a new initiative to ask President Trump to follow-up on the DOJ directive by issuing a formal Executive Order giving the directive teeth and the force of law.

c. Passing Legislation. NOM is involved in pushing the passage of legislation at the state and federal levels to protect people of faith from discrimination over their views about marriage. At the federal level we are working behind the scenes to urge the introduction and passage of the First Amendment Defense Act (FADA), critically-important legislation to protect supporters of marriage from being targeted by the federal government and coerced into participation in same-sex ceremonies that violate their beliefs. We expect this legislation to be introduced soon, and we will mobilize tens of thousands of grassroots supporters behind it. We also will be pursuing similar legislation at the state level

Dear Marriage Supporter — I am excited to write to you today to review our comprehensive, integrated Strategic Plan for 2018. We have an ambitious agenda and a lot of work on our plate, but with the help of grassroots supporters like you, I am confident that we can make significant progress.

To fight for the restoration of marriage, to secure the protection of Americans to continue to honor marriage as the union of one man and one woman, to educate Americans about the importance of restoring true marriage to our laws and to celebrate the complementarity of the sexes recognizing the unique and irreplaceable contributions that men and women make to human flourishing.

So we have a nice-sounding mission statement, but what does it mean in practical terms? It means a strategic plan with specific components in each of the core areas that impact us: public education, grassroots engagement, public policy advancement, judicial intervention and political action.

First Freedom Initiative

A major focus of our work for the coming year is the First Freedom Initiative (FFI), a plan to group all of the threats to marriage, religious freedom and the truth of gender under one initiative. Our First Amendment protects the rights of individuals who do not want men in girl’s bathrooms as much as it protects the rights of individuals and businesses not to participate in same-sex unions. In the end, the real question we must address is, “Will we stand for the First Amendment guarantees that our Founding Fathers gave to us? Or will we simply allow our system of government to be undermined and people of faith punished?”

We know the American people agree with our answer: We will stand firm in defense of our first freedom and our constitution.

Here is a brief overview of our top priorities:

1. Fight to restore marriage to our nation's laws.

When the U.S. Supreme Court imposed abortion on the nation in the Roe v Wade decision, they expected the ruling would settle the contentious issue once and for all and that the country would accept the decision. It didn't because the pro-life community was determined to continue the fight for life, and they have been incredibly successful. That is the position we are in now with marriage in the wake of the Obergefell decision. Whether it takes two years or two decades or more, NOM is committed to pursuing all avenues to restore marriage to our laws.

2. Enact legal protections for people who support marriage.

Until marriage can be restored to our laws, it is imperative that supporters of marriage be able to act on their beliefs about true marriage and not be coerced or threatened with punishment for maintaining those beliefs. We are a leading group in the country working to achieve these protections. This includes seeking legal rulings by participating in cases like the Masterpiece Cakeshop case now pending before the US Supreme Court, working with the Trump Administration to obtain administrative directives such as the recent order from Attorney General Jeff Sessions, and passing legislation through Congress and state houses to protect people of faith.

3. Fight to preserve the truth of gender.

After LGBT extremists were successful in redefining marriage in the law, stripping it of its essential character as a gendered institution, they then pivoted into a headlong rush to redefine gender itself. The new orthodoxy is to portray laws and cultural mores that segregate areas such as restrooms, changing rooms, showers and locker rooms based on sex to be discriminatory, bigoted and harmful to those who claim to be "transgendered." NOM is one of few national groups pushing back against this phenomenon through public education, grassroots organizing, legal action and administrative, regulatory and legislative activities.

4. Fight to protect religious liberty.

In a culture where belief in biblical morality and traditional institutions such as marriage are increasingly seen as being counter-cultural and out of popularity with the elite, it's critically important that society and the elite accept, even if reluctantly, that it is the right of the counter-culture to exist as full and equal participants in civic life. It is essential that a strong defense of religious liberty be made, and NOM is helping lead such an effort. We are active in the administrative, regulatory, legislative and judicial arenas, as well as in the court of public opinion.

The World Loses a Great Leader as LDS President Thomas Monson Passes Away


Dear %%FIRST%% — It is with great sadness that I note the passing of a great leader, Thomas S. Monson, president of the Church of Jesus Christ of Latter Day Saints. President Monson devoted a lifetime of service to his Church, and to humanity. He leaves a long legacy of charity, kindness, love and humanitarian acts.

A stalwart champion for the family, President Monson served for more than five decades as an Apostle of the LDS Church. He became President in 2008 and one of his first high-profile responsibilities was to shepherd the LDS Church during the internationally watched, successful Proposition 8 campaign in California that reaffirmed marriage as the union of one man and one woman.

Despite facing criticism from radical activists who wished to redefine marriage, President Monson articulated a reasoned, calm, loving understanding of marriage based on scripture, and universal truth. The complementarity of man and woman is an essential element of God's design for humanity, and President Monson's defense of marriage as the union of one man and one woman was both principled and honorable.

The National Organization for Marriage sends our deepest respect and heartfelt condolences to President Monson's family and to all the members of the Church of Jesus Christ of Latter Day Saints on the passing of this great leader and friend of the family.

May God richly reward his sacrifice and service to his Church, his nation and to humanity.

Happy New Year and some great news…


Dear Marriage Supporter — I want to wish you and yours a happy and safe New Year's. Please accept my prayers and good wishes that 2018 will be a terrific year for you and your family. We are so grateful to have you on our team. You will be in my thoughts and prayers throughout this exciting year to come.

I also have some great news to share that shows how sometimes disappointment is turned into blessing. NOM normally has a major direct mail campaign underway at the end of the year, but due to a variety of factors beyond our control, our December mailing was held up. As a result the expected donations from that mailing didn't arrive in time to qualify for the $250,000 year-end matching campaign. I explained this to the group of donors who put up the funds for the match and they blew me away with their response: 'Brian, let's get the mailer out and extend the match through January.' Wow!

I can't tell you how many times I have been taken aback by the love and generosity of our supporters. It is a humbling experience to know that so many people are praying and sacrificing for us.

There will be plenty of time in the future to talk more about the extended match, but later in the week I want to begin to walk you through our detailed 2018 Strategic Plan. I think you will be pleased with our expansive plans.
