This premise is not quite a conclusion of law or finding of fact until subject to a rational basis review in our federal and state court system. Will the argumentation hold up under the courts rational basis standard of review? Will it pass constitutional muster for due process and equal protection?

"A committed and public union of equal yet opposite genders helps to unify and stabilize society, and promotes responsible procreation for both men and women."

The jury is still out....

This week, New Jesey showed that support for the SSM-merger is soft while support for marriage is solidifying, politically.

Excellent news and thank you NOM for the very good job your organization has been doing across the country.

Nothing succeeds like success. Heh.

According to one of the largest survey after the vote on Proposition 8, a significant portion of the self-identified gay-lesbian portion of the electorate actually provided the margin of victory for the CA marriage amendment.

Not all "gay-lesbian" voters favored the SSM merger in California, one of the most politically gay-friendly jurisdictions in the nation.

About 1,000 federal laws on the books administer taxes, transfer payments, and child custody or inheritance and property rights in state laws.

Government may not deny any person when administering benefits in civil law, equal protection and the application within its jurisdiction. According to the 14th Amendment and the Fifth Amendments in the US Constitution.

In other words, I suggest its not wise to celebrate victory on several legislative battles.

Wait for the judicial victories in the rule of law. There you indeed have something to crow about.

Defeats are just part of the normal civil rights process of public debate. I say vote away... Due process and equal protection governs the final outcome in the rule of law.

From a technical jurisprudence perspective, Maine, NY and NJ are good news because it shows gays and lesbians are politically powerless to consistently achieve their own equality. This makes the case for a suspect class and heightened level of scrutiny much easier to make.

The federal court start judicial review on 11 January.. It should be very interesting indeed to watch these proceedings on YouTube during this time.

Don't forget, Adam, more straight people support same-sex marriage, by huge numbers, than gay people. It's wrong to suggest that only gay people support same-sex marriage!

Very pleased that the good people of New Jersey voted NOT to neuter marriage. A committed and public union of equal yet opposite genders helps to unify and stabilize society, and promotes responsible procreation for both men and women.

I think at this point the court case in California, which will lead to the overturning of all marriage discrimination laws nationwide, is the more interesting news event. Thank you YouTube!
